AN IMC employee, who had raped a minor tribal girl of Betul for an extended period, which ultimately led her to give birth to two girls, has been sentenced to a 10-year jail term by Special Judge D R Ahirwar and a Rs 5,000 fine.
According to prosecution lawyer Udaiprapat Singh Khushwaha, accused Kailash son of Dhotaji Gupta (42) resident of Musakheri, was constructing his house in July 1999 where he met the victim first. She had come with a group to work as labourers at the construction site. They worked for three months and left for their village Lapajhari, Betul.
In 2000, Kailash and another friend of his went to Lapajhari village and inveigled the girl to accompany them. He told her parents that he would marry her, even though he was already married.
He first put her up at house behind CRP Lines, owned by one Ramchandra, and told everyone that she was his wife. Here he raped her a number of times and then shifted her to a house in Bombay Bazaar, where he continued to rape her.
Over the years, she gave birth to two girls. Things would perhaps have continued in this manner but Kailash’s first wife came to know about her husband’s misdeeds. While she was giving birth at the Jamnabai Gendalal Nema hospital at Udaypura, she met the victim and told her that her husband was already married and he had fooled her.
The victim went back home to Betul and lodged a complaint with the AJAJJ police. The court considered all the sexual relations Kailash had with this girl as rape, as the girl was a minor. There can be no consensual sex with a minor. The girl is 20 years at present, and at the time of the incident she was less than 16 years, the court said.
