A lawyers’ body on Friday has moved the Supreme Court seeking an order to restrain the government from going ahead with the proposed appointment of justice P Sathasivam as the chairperson of the National Human Rights Commission (NHRC).
Justice Sathasivam, currently governor of Kerala, retired from the Chief Justice of India’s post in April 2014. His appointment as the governor in September last had evoked strong reaction from his colleagues and the legal fraternity that opposed his move to accept the position.
The petition filed by All India Bar Association (AIBA) also wants a direction to the Centre to frame a transparent selection procedure and take consent from other available former CJIs who are below 70 years.
Senior advocate SP Singh mentioned the matter before a bench headed by Chief Justice HL Dattu, which agreed to list the petition for a hearing.
Referring to media reports, AIBA’s petition claimed justice Sathasivam was the only contender for NHRC’s top post. The current chairperson former CJI KG Balakrishnan is retiring in May this year.
