Magistrate to be in Headley probe team

India intends to send a magistrate along with a team of investigators and intelligence officers to the United States to record American-Pakistan Lashkar operative David Headley's statement.

India intends to send a magistrate along with a team of investigators and intelligence officers to the United States to record American-Pakistan Lashkar operative David Headley's statement.

A home ministry official said the government — that was likely to formally write to the US Department of Justice next week — wanted to make the magistrate a part of the team to ensure that Headley's statement could not be retracted at a later date and would carry greater weight.

The team will be sent when the US grants permission for direct access to Headley to record his statement under CrPC 164, which is admissible in an Indian court of law, the sources said.

The home ministry has also come around to the view that Headley's extradition would be near-impossible and take far too long. A direct access to him — face to face with Indian agencies —is the more practical option, an official said.
