The Supreme Court’s verdict on the validity of the government’s September 2006 notifications, declaring 2,183 roads as commercial/mixed land use streets, is still awaited.
But that has not deterred the Municipal Corporation of Delhi (MCD) from contemplating the declaration of thousand more streets as commercial in nature. The civic agency plans to make a similar notification this month-end.
Leader of the House Jitender Kochar said the MCD has completed its survey in all the 12 zones.
“The 1,000-odd roads will be notified once the Master Plan 2021 itself is notified. The MCD’s Standing Committee will send the list of roads to the Delhi government for issuance of a formal notification,” said Kochar.
In its survey in 2006, the MCD identified 2,183 streets that had already been commercialised at a rate of over 50 per cent. During that survey, Kochar said, the MCD had overlooked a large number of streets. “We received a large number of representations from traders and municipal councillors that roads in their area that were eligible to be declared as commercial/mixed land use streets had been left out.”
The Supreme Court had directed all traders operating in the 2183 roads to register themselves with the MCD by January 31 this year and restrained the MCD from recommending commercial activity in any more roads. The apex court is expected to give its verdict on the September 2006 notifications on January 31.
However, with pressure mounting from traders, the MCD is all set to add more roads to the earlier list of notified areas, despite the court orders. On this count, MCD officials argue that the court’s order only restrains from issuance of new notifications under the amended Master Plan 2001 and that it does not interfere with the process of notifying MPD 2021.
