india Updated: Aug 31, 2007 06:33 IST

Father of a victim of Nithari serial killing case has moved an application seeking that the main accused be charged for rape and murder also.

Nand Lal father of victim Payal(21) has moved an application through his advocate Khalid Khan against Moninder Singh Pandher to charge him under section 302(murder), 376 (rape) with 120B (criminal conspiracy) of IPC, Khan told PTI.

He said the CBI has charged Pandher under section 120B of IPC only.

CBI Judge Rama Jain reserved the order for September 5.

One more application was moved by Khan in the case for getting two police officers - Noida Circle Officer Dinesh Yadav and Noida Sector 20 SHO B P Singh - declared as absconder.

Earlier, Jain had issued non-bailable warrants on August 20 against both the police officers for allegedly taking bribe from Pandher and sheltering him. The Judge had also ordered CBI to produce them by August 29 in court but it failed to do so.

Meanwhile, both the officers have moved the Allahabad High Court for a stay on the proceedings.
