The Delhi High Court on Friday extended till September 25, the stay granted on the conduct of brain-mapping test against Rahul Mahajan and Sahil Zaroo in the infamous drug snorting case.
Justice BD Ahmed extended the stay after the prosecution sought some more time to file its reply on the two separate petitions filed by BJP leader Pramod Mahajan's son and Sahil Zaroo challenging the order of the trial court granting permission to the Delhi police to conduct the test.
The High Court had on July 20 granted the stay till August 18, after the duo contended that conduct of the test was an invasion of their privacy and violation of their fundamental right.
Counsels for the two accused had argued that there was also no scientific rationale or evidential value for the test sought to be conducted by the Delhi police.
The Delhi police had sought permission for conduct of the brain mapping test on the ground that the duo were not cooperating with the investigating agencies in conducting a probe into the tragic incident, in which Bibek Moitra personal secretary of late Pramod Mahajan died, while Rahul managed to survive after the two allegedly snorted drugs supplied by Sahil Zaroo, an alleged drug supplier.
