Thinking of getting approval from the Municipal Corporation of Gurgaon (MCG) for a building plan? The ordeal of 88-year-old Balbir Singh Yadav would make you to reconsider your plan.
Yadav, a retired customs department official, has complained of being harassed by the officials of the Municipal Corporation of Gurgaon, who have restricted construction on his plot which he had bought in 1964.
Since June last year, the octogenarian is yet to get response to his application seeking permission to erect a boundary wall on his plot near Rajiv Chowk on NH-8.
“My heart bleeds when I look at the semi-built walls on my plot. It is prone to encroachment. Several such attempts have been made in past. I can’t get MCG’s permission to safeguard the property my father bought in 1964,” said Dharmender, Yadav's 48-year-old son.
The MCG had demolished the boundary wall and carved out a street in the middle of the plot. According to the civic body, the plot falls on the path of the lane which connects the nearby colonies with the service lane along the national highway.
However, Dharmender said, in 1996 the MCG’s claim was denied by a court which also confirmed the ownership of his father on the plot.
According to the Haryana Municipal Corporation Act, within 60 days after the receipt of a notice if a building plan is not rejected by the commissioner, the construction shall be considered as sanctioned.
But, Yadav, who is also suffering from arthritis, is yet to get relief from visiting the MCG office regularly even after 10 months of filing his application.
When Hindustan Times enquired about the case from joint commissioner Veena Hooda, she said: “Our engineer gave a report which clearly shows that there is a sewer line in the plot and moreover, the plot has a galli (street) inside it. Now our planning branch would decide it further.”
A senior MCG official, who is familiar with the case, said: “If the court had given orders against the MCG then the applicant must have filed a contempt case against the corporation. And when the MCG says there is a sewer line inside the plot then either the applicant should be allotted an alternate plot or some alternate arrangement should be made for the sewer.”
