The rest of Tehelka co-founder Tarun Tejpal’s bail plea will be heard in-camera when it comes up on Tuesday. Arguments began on Saturday. The principal sessions judge had earlier dismissed an application made by him for an in-camera hearing.
"At the outset it was submitted... that it is imperative to have the in-camera hearing of the bail application as the same would facilitate an effective hearing in terms of the mandate of Article 21 of the Constitution of India," said a note from his team.
"It was further submitted that at the stage of bail it is obligatory/ imperative for the court to harmonise the presumption of innocence of the accused with the materials collected in course of investigation which in light of the sensitive nature of facts in the present case, cannot be done in public gaze."
Tejpal was on Saturday sent to 10 more days in jail under judicial custody by a Panaji magistrate’s court.
He has already spent 10 days in police custody and 23 days in jail under judicial custody, since his arrest on November 30, 2013, for sexually assaulting a junior colleague. The prosecution is yet to argue its case against the bail. The hearing will continue on Tuesday.
