Transfer of nazul land cancelled

THE COURT of Additional Divisional Commissioner R K Tiwari has upheld the decision of the court of Indore SDO Uma Shankar Bhargav about one acre nazul land at Chhota Bangarda, which a landholder had showed as part of his landholding. Bhargav had cancelled the transfer of land to the purchaser.

THE COURT of Additional Divisional Commissioner R K Tiwari has upheld the decision of the court of Indore SDO Uma Shankar Bhargav about one acre nazul land at Chhota Bangarda, which a landholder had showed as part of his landholding. Bhargav had cancelled the transfer of land to the purchaser.

About four years back, landholders Mata Prasad and Rama Shankar sold the land to Mukesh son of Sanat Kumar. After purchasing it, when Mukesh could not get land transferred in his name, he encroached upon the surrounding land that belonged to a housing cooperative society and sold off the plots.

The one-acre Nazul land adjoining this land was entered into records as belonging to Mukesh. When the matter surfaced two years ago, Indore SDO not only cancelled the transfer of government land but also issued notice to patwari and stopped his increment. Inquiries were instituted and the police were asked to register the case.

Meanwhile, SDO’s order was challenged in the Additional Commissioner’s court. In a recent order, the Additional Commissioner has recommended disciplinary action against patwaris and tehsildar responsible for hobnobbing with private landholder and showing the government land as belonging to the former.
