A SEWRI fast track court on Wednesday acquitted two men, Shrikant Dhulap (26) and Yogesh Kharat (25), accused of kidnapping and murdering a Class 10 student of JV School in Bhandup in 2004.

According to the prosecution, on May 14, 2004, Dhulap and Kharat had invited 17-year-old Kaushal Joshi and two of his school friends to a beer party at another friend Chetan Jesud’s (25) house in Kanjurmarg. Joshi’s body was found the next morning at Kanjurmarg, his head badly smashed by stones.

Ad hoc Sessions Judge S.R. Trivedi acquitted Dhulap and Kharat saying the prosecution had failed to prove the case. The court gave the two accused the benefit of doubt after several discrepancies were found in deposition of Jesud, a key witness, and also the prosecution’s failure to prove the ransom motive.

Though Jesud said that the four accused had left his house to drop Joshi at his Hiranandani Gardens residence in Powai after the party and returned 45 minutes later, he had found no bloodstains on their clothes. He also gave a wrong
description of the clothes worn by Joshi.
