UP: Angry with disturbance during meditation, SDM jails gardener

A gardener in Gorakhpur was arrested, made to spend 30 hours in jail and granted bail only after his colleague furnished a bond of Rs 1 lakh. His fault? He apparently disturbed a bureaucrat — sub-divisional magistrate (SDM), Sadar, Neha Prakash —while she was carrying out meditation and yoga at a public park.

A gardener in Gorakhpur was arrested, made to spend 30 hours in jail and granted bail only after his colleague furnished a bond of Rs 1 lakh. His fault? He apparently disturbed a bureaucrat — sub-divisional magistrate (SDM), Sadar, Neha Prakash —while she was carrying out meditation and yoga at a public park.

The gardener, Vishwanath Yadav, was sent to jail on charges of disturbing peace under section 151 of the Cr Pc. However, he was released following much pressure on the administration due to media reports.

SDM Sateesh Pal said, “Till yesterday (Tuesday) evening, the accused could not present the documents required for bail and that is why it was granted on Wednesday morning.”

No administrative official, including the SDM in question and the DM, was ready to comment on the issue.

Meanwhile, a shell-shocked Yadav still wondered what was his fault that landed him behind bars. “I did not know that I was committing such a big mistake by cutting grass near an official who was meditating. Once, she warned me against cutting the grass as the noise from the machine was disturbing her. I moved the grass cutter to another area of the park, about 600-metres away, and still she got me arrested and sent me to jail for no reason,” recounted Yadav.

He urged the officials to sugways for him to perform chores with the grass cutter without emitting noise. Following his arrest, his colleagues first tried to reason it out with the police but when they refused, they approached a lawyer seeking his release.

Vishwanath, who has been working as a gardener in the Pandit Govind Ballabh Pant Park in Gorakhpur for more than 10 years, said his arrest had shaken his family so much that no meal has been cooked since in his quarter, situated at the corner of the park where he lives with his two sons and wife. A sanitary worker at the park, Ram Avadh, said, “Hundreds of people come here for morning walk, meditation and exercises. It is hard to identify officials and give them special treatment. Arresting someone for creating disturbance in meditation was sheer injustice.”

“When we came to know that policemen had taken him (Yadav) into custody, we rushed there but nobody was willing to listen to us,” he said.

The Gorakhpur Development Authority Workers’ Association and BJP MP Yogi Adityanath have condemned the arrest, saying that the SDM had an ego problem. Yogi also targeted the Samajwadi Party (SP) government for its “corrupt bureaucrats”. “Lodging a poor (man) in jail for creating disturbance in meditation is an inhuman act and shows the insensitivity of the SP government and its corrupt bureaucrats,” said Yogi, adding, the park was not the right place for doing yoga.
