BJP MP Varun Gandhi today filed a preliminary objection on the maintainability of a petition filed in the Allahabad High Court challenging his election to the Lok Sabha from Pilibhit for allegedly delivering a hate speech in the constituency prior to the polls.

In an affidavit filed on behalf of the young MP, senior advocate Keshri Nath Tripathi said that the petition, seeking cancellation of Gandhi's election on the ground of his involvement in a case pertaining to an alleged hate speech, was not maintainable as it had been delivered much before the elections and could have no bearing upon the poll process.

The petition has been filed by V M Singh, Gandhi's maternal uncle who had unsuccessfully contested from Pilibhit on a Congress ticket in the general elections held last year.

Justice S K Tripathi posted the matter for further hearing tomorrow.
