Woman paraded naked, jailed over rape charge

CAN A woman be booked under rape charge? Can a tribal be booked under the Prevention of Atrocities Against SCs, STs  Act?  Phoolvati of village Dhedhgaon in Harda district is an example. She has already spent 10 days in jail after having suffered the humiliation of being paraded naked in the village on September 30.

Her crime? Two minors were found in her courtyard in a compromising position by the girl’s brother when she was not at home.

After being released, Phoolvati narrated her ordeal to journalists here on Friday. Samajwadi Jan Parishad activist Shamim accompanied her.   

The tribal woman said that the police first registered a case against her under sections 254, 342 and 34 of the IPC for aiding and abetting rape. Later, section 376 of the IPC along with 34 (3) (11) of the Prevention of Atrocities Against SCs and STs Act was also slapped.

The boy’s mother Shakun along with five other women had barged into Phoolvati’s house, beat her up and paraded her naked in the village till she fainted. When her father-in-law Chhotelal went to Chhipabad police station to lodge a complaint against the women, he was refused.

It was only after a TV channel flashed the report about the stripping incident that Harijan Kalyan police, Harda registered a complaint on October 3.

But instead of acting against the women who had harassed her, she was booked under section 342 of the IPC and arrested along with an eyewitness to the shameful incident.

Four of the six women allegedly involved in the stripping incident have also been arrested under sections 352, 323 and 354 of the IPC. But the boy and her mother are still at large.

Shamim alleged that accused minor Madan’s family is related to district Janpad president Asha Patel and enjoys patronage of Revenue Minister Kamal Patel.      

SP in charge of Harada Sudhir Laad, however, denied that Phoolwati Bai has been booked under section 376 of the IPC, though the remand paper mentions this section.  He said police are trying to arrest Madan and his mother.
