A division bench comprising Justice Shantanu Kemkar and Justice MC Garg admitted the petition of Keshav Dev, father of late IPS officer Narendra Kumar, seeking enhancement on imprisonment of the convict.
Dev filed a petition through advocate Manish Yadav, advocate Amit Sisodiya and advocate Vishal Sharma.
Talking to mediapersons, advocate Yadav said that the court has admitted a petition filed by Dev, father of late IPS officer, who is seeking enhancement of imprisonment of the convict Manoj Gujjar, who is allegedly responsible for untimely demise of his son. The court has set the hearing in the case for next week.
The court also issued a bailable warrant against Gujjar and directed him to appear before the court on November 10, 2014.
Advocate Yadav added that the petition has been filed two weeks ago and responding to this, representatives of the investigation agency appeared in the court on Monday at the Indore bench of Madhya Pradesh high court.
A special CBI court had convicted accused Manoj Gujjar on February 22, 2013 under Section 304 (A) (culpable homicide) and Section 353 (use of criminal force to prevent a government official from discharging his duties) of the IPC and Section 181 of the Motor Vehicle Act and awarded him 10 years of rigorous imprisonment in connection with Kumar’s death.
The 30-year-old, a 2009 batch IPS officer, Kumar was crushed to death on March 8, 2012 in Banmore. He was initially suspected to have been killed in a conspiracy by mining mafia but subsequent investigations ruled this out.
