Court notice to Union minister Nihal Chand in 4-year-old sexual assault case

A Jaipur metropolitan court on Thursday issued notices to Union minister of state for the ministry of chemicals and fertilizers Nihal Chand Meghwal and 16 others in a four-year-old sexual exploitation case.

A woman had filed a case of sexual exploitation by her husband and others in 2011. She had accused her husband of drugging her and then letting his associates rape her in Jaipur. In the FIR, the victim had also named Nihal Chand Meghwal, the only minister from Rajasthan in Narendra Modi cabinet.

A year later, after investigation the police closed the case in 2012, saying the charges were false and fabricated.

The victim had then approached the court against the final report which was submitted by the police.

The court had accepted final report and then she filed protest petition in the court which was also dismissed by the trial court.

Thereafter, she approached the district court in revision against lower court order. The district court also dismissed the charges.

Then she went in for revision, following which additional district judge Prem Prakash Gupta on Thursday issued notices to Meghwal and 16 others in this case asking them to respond by the August 20.

Earlier, on the petition of one accused Prakash Garg, Justice KS Ahluwalia of Rajasthan high court had ordered in April that all accused should be made party and they should be heard before deciding the revision.

The Jaipur police had November 23, 2011 filed an FIR against 17 persons, including political leaders and police officers, on charges of drugging and raping a woman and making sleaze CDs.

The case was registered a day after a court directed the police to file the FIR on the basis of a complaint lodged by the victim, a resident of Sirsa, Haryana under Section 156 (3) of CrPC.

The police had filed FIR naming Meghwal, former minister Jogeshwar Garg, former Rajasthan University Students Union president Pushpendra Bhardwaj, former Assistant commissioner of police Anil Rao and 13 others on charges of rape.
In her complaint, the victim had said that she got married to one Om Prakash Godara on December 20, 2010. Soon after her marriage, the husband along with 16 other accused raped her between February 2011 and September 2011 in various parts of Jaipur.
