Justice Soumitra Sen, facing impeachment on the recommendation of Chief Justice of India K.G. Balakrishnan, isn’t considering resignation and will defend himself as and when required, his counsel has said.
Subhas Bhattacharya, representing Justice Sen of the Calcutta High Court, said: “If showcaused by Parliament, he will appear before it. He will defend himself in accordance with the law.”
Justice Sen’s wife Anuradha said he was not taking any calls and was not talking to media as it was a “sensitive issue”. She said Bhattacharya would answer queries on his behalf. On Justice Sen’s reaction to the CJI’s recommendation, she said: “Try to put yourself in his situation and you will understand.”
Sen will face impeachment proceedings in Parliament with the government accepting CJI’s recommendation to the PM for his removal on charges of serious financial “misconduct”.
In an internal inquiry held by Balakrishnan, Sen was allegedly found to have indulged in financial misconduct when he was a practising lawyer. He allegedly received Rs 32 lakh as court-appointed receiver in a lawsuit and deposited the amount in his personal account.
