The Lucknow bench of the Allahabad High Court has directed the UP Chief Secretary and the Union Cabinet secretary to record their appreciation in the Annual Character Roll of an IAS officer for her positive attitude in helping resolve a controversy. The efforts of the officer had resulted in a petitioner being allowed to rejoin his present place of posting with all consequent benefits, like sanction of leave and payment of salary.
The IAS officer in question is Vrinda Swarup, Principal Secretary, Department of Vocational and Technical Education. This directive was issued by a bench, comprising Justice Uma Nath Singh and Justice Ved Pal.
The petitioner, Yashwant Kumar, was the principal at the Mahatma Gandhi College, Hathras, but was demoted as lecturer even though no inquiry was conducted.
Appearing for the petitioner, senior advocate Anil Tewari argued that the approval of the director, Technical Education, which is mandatory, had not been obtained before punishing Kumar. On behalf of the state, it was argued that the petitioner had not been demoted and despite remaining seriously ill, he was paid his salary.
On perusal of the affidavit of the petitioner, the court found the statement of the respondent to be incorrect. It then summoned BR Verma, assistant director, Technical Education, along with principal secretary, Vrinda Swarup.
On July 17, the court directed the principal secretary to resolve the dispute within two weeks.
