Terming it guilty of causing harassment and mental agony to the complainant, district consumer disputes redressal forum, Fatehgarh Sahib, has directed ICICI Lombard General Insurance Company Ltd, Ludhiana, to pay claim of a dead cow to a resident of Badla village of the district.
In his complaint before the forum on May 14 this year, Jasvir Singh submitted he got his cow insured with ICICI Lombard General Insurance Company Ltd, Ludhiana.
The cow died on September 20, 2012, following which Dr Sadiq of civil veterinary hospital, Walwan in the district, got the cow's autopsy conducted on the same day.
The insurance company's surveyor also visited the spot and conducted inquiry about the matter, and took photographs on the spot and time of autopsy.
Thereafter, Jasvir submitted relevant papers to seek claim, but the company rejected it on the grounds that "tag was not intact with ear".
Jasvir claimed that at the time of the autopsy, the tag was intact and it was also submitted along with papers submitted to the company, adding that as per the photographs, it was evident that the tag was intact in the cow's ear.
In its reply, the firm contended that Jasvir with dishonest intentions had changed the insured cattle in order to get undue benefit. The tag received by the company from the villager was not intact with the ear of insured cattle, which was against the claim procedure.
However, accepting the complaint, the forum observed that the company was deficient in service by not settling the claim of the villager, and directed the company to pay Rs 50,000 to the villager as the claim, and Rs 5,000 on account of compensation for harassment and mental agony, besides Rs 3,000 as cost of litigation.
