BMC considers contempt of court petition against residents

By refusing to vacate their flats, the families living in the 96 illegal flats in Campa Cola compound have likely put themselves in a legal bind as they have violated the undertakings they submitted to the Supreme Court (SC).
Responding to residents’ special leave petition, the apex court had given them an extension of five months on May 2 to vacate their flats, but it had taken undertakings from them that stated that the flats would be vacated voluntarily by occupants before the October 2 deadline.
This deadline was later extended to November 11 by the court on October 1, a day before the demolition scheduled by the civic body.
The civic body is now considering the possibility of filing a contempt of court petition in SC against Campa Cola residents for violating their undertakings.
Additional municipal commissioner Mohan Adtani said: “The Supreme Court’s order is clear.We will wait for another one to two days for residents to vacate
and allow the demolition of the illegal flats. If the resistance to vacate continues, we will consider such an action.”
Adtani said the planned schedule for demolition would continue on Wednesday.
“The residents’ defiance of the apex court order is shocking. They cannot brazenly get away with flouting the order,” said a senior civic official, who did not wish to be identified. “We are preparing to represent our side with evidence of their resistance to our demolition proceedings.”
Residents on Tuesday locked the two gates of the compound,parked their cars in such a manner as to not allow BMC vehicles to enter, formed human barricades
inside and outside the gates and prevented civic officials from entering the complex.
