BMC must compensate couple whose baby was stolen: HC

The Bombay High Court on Monday rapped the state government and the Brihanmumbai Municipal Corporation (BMC) for not paying compensation to a couple whose baby was stolen from Sion hospital a year ago.

The division bench of Justice Ranjana Desai and Justice V. K. Tahilramani was hearing a petition filed by a Chembur couple-Mohini and Mohan Nerurkar-who lost their newborn baby boy from Sion Hospital on January 1, 2009.

An unknown woman allegedly stole the boy when Mohini had gone to the washroom leaving the child on the hospital bed.

Nerurkar's lawyer, Ashish Chavan told the court that although the corporation has deposited Rs 5 lakh towards interim compensation in the high court, it was not paid to the couple.

Justice Desai said: “What is the problem in paying compensation? The civic body has ample money.”

Public Prosecutor Pandurang Pol said the state had no role to play in the case. The BMC had taken a stand that it wasn't responsible for the loss of the baby. Justice Desai asked, whose responsibility was it to protect the lives of citizens? “Ultimately the state and the BMC cannot evade their responsibility.”
