The civic body has asked builders and developers to provide a guarantee for the life of the flat they sell.
The Brihanmumbai Municipal Corporation (BMC) will recommend to the state housing department to make necessary amendments in the Maharashtra Ownership Flat Act so that builders/developers would have to provide a guarantee of the structure or building in their agreement with the buyers. This is aimed at ensuring that builders do not resort to sub-standard construction and defraud the buyers.
Municipal commissioner Swadheen Kshatriya informed the civic Improvements Committee about this move. The committee will discuss this proposal in its meeting on Friday.
The move was initiated by Advocate Manmohan Chonkar, a Shiv Sena corporator, and cleared unanimously by the civic general body in June 2008.
Chonkar said: “When I buy any product such as a refrigerator, television set or even a brand new car, I ask for a guarantee. Its appalling that this does not happen while a new flat is sold for lakhs of rupees.”
He added: “When the civic body gives the commencement certificate to the developer to start construction, it should ask for the guarantee about the structure and should not approve the building plan until the same is stated in the 'agreement of sale.”
