The state government has been asked to expeditiously consider the renewal of a discotheque licence for Hotel Sea Princess at Juhu.
Sea Princess Hotel Properties Pvt Ltd had moved court saying that police authorities were disrupting their business, thereby causing loss to them and for the workers.
A division bench of justice PB Majmudar and justice RM Sawant, on Thursday, told the police to consider renewal because other five star hotels are engaged in similar activities after obtaining a licence. The court said this should be considered so that the petitioner hotel does not lose out on competition with other five star establishments.
The court also observed that such establishments should not be compared to a dance bar.
Justice Sawant said if there were instances where people throw cash at dancers then action can be taken against them and the discotheque can be issued a show cause notice. Petitioner’s advocate Mukesh Vashi said the neighbours are not disturbed because the activities are carried out within the premises.
Vashi also cited examples of other five star hotels such as JW Marriot and Hyatt in the vicinity of Sea Princess, which were permitted to run discotheques. He also stated that their hotel has got exception under the shops and establishments act to carry on till 3am.
Petition states that their application has been kept pending without any reason and have been forced to close down their business. The case has been adjourned till September 5.
