The Thane district consumer forum has ruled that builders must give amenities ordered to be provided by the civic body, by way of conditions to permissions granted for a housing project.
The bench comprising forum president RB Somani and member Jyoti Iyer ordered Radha Krishna Developers to pay Rs. 9.40 lakh to Sarvottam Co-operative Housing Society at Vishnu Nagar, Thane for not providing the promised amenities.
The housing society alleged that the developer had failed to construct a compound wall as promised and provide solar water heater and rainwater harvesting system.
They also sought compensation for the use of sub-standard quality construction material, which resulted in leaking of the roof as well as sidewalls, and moved for possession of the office space of the housing society.
The developer denied the claim of including these in the list of promised amenities.
"These amenities are clearly mentioned in the Occupancy Certificate, and therefore, the developer is bound to provide them," the forum concluded and directed Radha Krishna Developer to pay Rs. 9.4 lakh to the housing society towards failure to provide the promised amenities among outstanding maintenance and litigation charges.
