The Bandra metropolitan magistrate’s court on Tuesday issued a non-bailable warrant against a film producer and distributor for failing to appear before the court on several occasions in connection with a case of a cheque being dishonoured.
The court was conducting a case under Section 138 (dishonour of cheque due to insufficiency etc, of funds in the account) of the Negotiable Instruments Act against Israr Ahmed on a complaint filed by another film producer, Moti Tolani, in December last year.
According to Tolani’s lawyer, Laxman Kanal, Tomal had loaned Ahmed Rs 4.8 lakh in 2008 for the distribution of films. But, in 2009 the cheques that Ahmed gave Tomal were allegedly dishonoured, following which a case was filed. Though the court had granted Ahmed bail, it had directed him to appear before the court for hearing. As Ahmed failed to appear before the court, a warrant has been issued.
