A team from the Enforcement Directorate (ED), Delhi, is camping in Mumbai to prepare a stronger case to file an appeal against the bail granted to Pune businessman Hasan Ali Khan.
A special court in Mumbai had, on Friday, granted bail to Khan after the ED failed to produce a single authentic document to prosecute the Pune businessman whose Swiss bank account showed transactions of US$ 8 billion (Rs 36,000 crore).
The ED plans to approach the Bombay high court to file an appeal against the order.
The Supreme Court, too, had recently reprimanded the ED for not conducting custodial interrogation of Khan and others involved in parking black money abroad.
Sources in the ED had said that the appeal would be prepared under the supervision of the Delhi team. The ED, Mumbai, would also submit a detailed report on the failure to get Khan’s custody, to its head office in Delhi.
On Saturday, as per the bail conditions, Khan visited the ED office at Nariman Point around 11 am. From 11.15 am to 2 pm he was questioned by ED authorities. While granting bail, the special court had directed Khan to remain present in Mumbai for five days and report to the ED office between 11 am and 2 pm. The Delhi team was also present in the Nariman Point office during questioning.
Sources said during Khan’s questioning in these five days, the ED would try to pick up some new points that could help them prepare a stronger appeal.
