HC directs ACB to register case against cop

The Anti-Corruption Bureau (ACB), on Thursday, was directed by the Bombay high court to lodge a first information report (FIR) against an assistant inspector attached to the Oshiwara police station in an alleged extortion case.
A division bench of justice AM Khanwilkar and justice AR Joshi asked the ACB to take appropriate measures to register the FIR against API Balasaheb Khade and apply relevant provisions of law, including under the Prevention of Corruption Act.
Additional commissioner of police, ACB, Niket Kaushik was present in the court on Thursday. The court was hearing a petition by a Santacruz-based businessman Aminuddin Saeed alleging the ACB had failed to act against Khade despite a trap laid for him.
Instead, Saeed said, he and his industrialist friend Umesh Reshamwala were arrested for allegedly raping a model.
Pradeep Havnur, Saeed’s advocate, argued that Saeed was targeted as he had filed a public interest litigation in 2009 alleging violations in a redevelopment scheme in south Mumbai.
Reshamwala, who has polio, had sought Saeed’s help after receiving threats from an upcoming model. She had even sent a blank CD. When Saeed went to Oshiwara police in February 2010 to lodge a compliant against the model, Khade allegedly refused to do so and asked him to come later.
Saeed again went to the police station on February 7, Khade allegedly threatened him that he had received a complaint against Reshamwala in a sex scandal. Khade allegedly demanded Rs 2 lakh to settle the matter, failing which he would implicate Saeed in the scandal, Havnur argued.
On February 9, 2010, when Saeed went to meet Khade, ACB officers hid a digital recorder on Saeed. “Despite the recorded conversation between Saeed and Khade where the latter demanded a flat in Goregaon and threatened to implicate him in a false case, the ACB did not act,” Havnur said.
Three days later, the model lodged a complaint against Reshamwala and Saeed alleging she was raped by the duo over the past 7 months. The two are out on bail in the case.
Havnur alleged that someone had leaked the information from the ACB’s office to Khade and hence he lodged
a false case against Saeed and Reshamwala.
