The producers of soon-to-be-released Hindi film Mausam received a major relief on Tuesday after the Bombay high court dismissed a motion moved by another producer seeking injunction over the use of title of the movie.
Film and television producer, High Definition Television, had moved an appeal claiming rights to the title of the film directed by Pankaj Kapoor.
HDT argued they had registered the title with the Association of Motion Pictures & Television Producers in April 2001. According to HDT, even though they had renewed the registration seven times since then, the association granted it to Mausam producers.
Advocates for Mausam producer said that AMPTP is not a statutory authority and hence the issue of owning title is irrelevant. A division bench of justice DK Deshmukh and justice AV Mohta said that the court cannot enforce the rules of the association as it is not a statutory body.
“There can be two movies under the name Mausam,” the court said.
