HC orders probe into rape-cum-murder of minor girl

The Bombay High Court has directed the Superintendent of Police, Thane (rural) to probe the case of alleged rape and murder of a 13-year-old girl.

The Bombay High Court has directed the Superintendent of Police, Thane (rural) to probe the case of alleged rape and murder of a 13-year-old girl.

The girl (name not disclosed) went missing from the her school picnic group in August, and her dead body was found in a river near Vasai's Tungareshwar temple.

The division bench of Justices A M Khanwilkar and A P Bhangale was hearing a petition filed by the girl's father Rajesh Pawar alleging police failure in probing the case.

According to the petition, Pawar's daughter, a VIII grade student of Holy Cross High School in neighbouring Nalasopara, was a part of the group of 225 boys and girls who had gone to Tungareshwar on August 27.

The girl soon went missing, and her body was found two days later in the river in a disrobed condition.

Pawar's lawyer Shyam Marwadi argued that the police did not even examine the doctors from the local civil hospital who conducted the post-mortem.

"Initial report suggests that there was possibility that she was raped and then killed," he said.

However, police only filed a case under section 304 (a) of IPC (causing death due to negligence) against the school authorities.

Ganesh Sovani, lawyer for the investigating officer and deputy SP Deepak Deoraj said the police did not find any evidence of rape or murder.

High Court on Tuesday asked Pawar to submit the points raised by him in the petition to the Thane SP. The SP is to examine them, and file an affidavit by November 26.
