Hookah parlours, including Mocha, moved the Bombay high court challenging the civic circular that was upheld by the court last month. The circular prohibits sale of tobacco or tobacco related products in any form.

The court on Friday said that since an order had already been passed, the petitioners should approach the Supreme Court. On advocate Veena Thadani’s requests, the court to kept the case for hearing on Wednesday.

Earlier last month, the court had upheld the BMC’s circular, which was issued after the court asked the BMC to incorporate terms and conditions of the Cigarette and Other Tobacco Products Act. The order came during the hearing of a petition filed by NGO Crusade Against Tobacco, which alleged that hookah parlours were selling tobacco products to minors.
