Police book developers for culpable homicide

The Matunga police arrested Ketan Shah, director of Success Developers Private Limited, in connection with the elevator mishap at La Sonarisa building in which five persons were killed and one critically injured.

Senior inspector Sunil Deshmukh told the Hindustan Times that Shah has been booked under Section 304 (culpable homicide not amounting to murder) of the Indian Penal Code. Boman Irani, chairman and managing director of Rustomjee Developers, is among the accused.

Deshmukh said the other accused in the case are Persy Choudhari, director of Rustomjee Developers, Kaushik Shah and Chandresh Mehta from Success Developers, and the lift contractor, Bipin Singhania.

They have also been charged for attempt to commit culpable homicide.

“We will also be registering cases against officials from the Slum Rehabilitation Authority [SRA],” Deshmukh said, adding that the police will be questioning SRA officials on Monday.

Deputy commissioner of police (zone IV), Sanjay Baviskar, said it was a case of negligence. “We have asked technical experts to give us the reasons for the tragedy. The report should help us nail those responsible for it,” he said.

Baviskar said the police did not know whether all permissions were obtained for the elevator. “Tomorrow we shall get in touch with the various departments to find out,” he said.
