The Metropolitan Magistrate’s court in Borivli, on Wednesday, told the Malvani police to conduct an inquiry on a medical report given by Bhagwati Hospital in an assault case.

A police official from the Malwani police station said: “We have been directed by the court to seize the medical documents provided by Bhagwati Hospital to Asif, the complainant, and produce it in the court.”

On May 23, the police registered a case under section 326 (Voluntarily causing grievous hurt by dangerous weapons or means) and 504 (Intentional insult with intent to provoke breach of the peace) against Mohammed Usman Sheikh on a complaint filed by Asif.

“Sheikh was arrested on May 29,” said Sheikh’s advocate Kshitij Mehta. On May 31, when Mehta filed an application seeking medical papers from the hospital, the hospital produced some documents that were not related to the case. “The police said Asif had sustained fracture in his small finger but the hospital produced eight X-rays of different parts of the body but no X-ray were produced concerning his little finger”, added Mehta.

“The court has issued a search warrant against the hospital and also directed the police to seize the medical papers, OPD papers and X-ray,” said Mehta.
