A 29-year-old man, arrested for allegedly raping and murdering a minor and then dumping the body on the terrace of a police quarters building, was today released on bail after the police failed to file a charge sheet within the stipulated period of 90 days.
Mohammad Ajmeri Shaikh, a rickshaw driver, was arrested on March 9 this year for allegedly raping and then murdering a nine-year-old girl. The victim had gone missing from her home in Nehru Nagar at surburban Kurla on March 5. Her body was recovered the next day from the terrace of a building in the police quarters nearby.
The sessions court rejected the bail plea filed by Ajmeri last month, stating that it was a serious offence and there was prima facie case against him. However, the suburban Vikhroli metropolitan magistrate granted him bail.
"It has been three months since the alleged incident and the police have not yet filed their charge sheet. As per law, if the charge sheet is not filed within the stipulated time, the accused can be released on bail in default," Ajmeri's lawyer Prakash Wagh said.
Ajmeri had approached the sessions court last month claiming that he has been falsely implicated by the police due to the hue and cry created by local people over no action taken by the police in the case.
