RTI reveals lapses in luxury building plan

A citizen of Somanigram, Goregaon, using information obtained under the Right to Information Act, has raised issues over construction of a luxury residential project in the area.

Sulaiman Bhimani, an interior designer, has alleged irregularities in the under-construction residential project of RNA Corp called Exotica, which is located opposite MMRDA Colony, Shivajinagar, Somanigram.

In the brochure, Exotic is a ground plus 36-storey futuristic residential project located in Goregaon (West) with all facilities. But, information obtained by Bhimani revealed that the building’s approved plan was only till the 14th floor and had no basement. “In the payment schedule, RNA mentioned a charge for basements one and two. If their basement is not approved, why are they charging for it?” Bhimani said.

He said the RTI also revealed that MMRDA issued RNA Exotica both the Intimation of Approval (IOA) and Commencement Certificate (CC) on the same day – August 5, 2009. “There has to be a time gap between the issuance of an IOA and a CC, as some of these conditions require physical and on-site verification by MMRDA officials,” Bhimani added.

Somanigram residents also complained that the developer had blocked the public road for construction purposes, which was inconveniencing them. “We cannot use the public road anymore. In fact, the developer should be first developing the roads and then start construction of the building,” said Dr Abdul Kalim, another resident of Somanigram.

The developer, however, insists he has obtained all required permission. RNA Corp’s vice president Manoj John said, “Currently, we have plans approved for construction till the plinth level. The CC and approved plans are issued stage-wise so we will obtain them as per our requirement.”

He added, “The road will be handed over to MMRDA after the construction is over. It’s a huge structure and we are using the road only to store material.”

A spokesperson from RNA Corporation said the IOA was issued on December 1, 2006 and the CC on March 29, 2007. “The CC was then re-validated till March 28, 2011. As of now, there is no basement in our plan.”

MMRDA officials were not available for comment.
