Rustic background helps 5 men escape contempt charge

Five persons from Ahmednagar were recently granted respite from a contempt of court charge owing to their rustic background.

Five persons from Ahmednagar were recently granted respite from a contempt of court charge owing to their rustic background.

These five men were charged with contempt proceedings for their conduct and alleged intimidatory behaviour towards a lower court judge.

While hearing a criminal contempt petition filed by Ahmednagar civil judge VS Deshpande, the Aurangabad bench of the Bombay HC granted relief, after taking into account their rustic nature and asking them to tender an unconditional apology. The bench said it will be lenient towards them “since patience, wisdom and prudence are rare virtues.”

Deshpande had issued a show-cause notice for contempt to Sayyad Amin, Rahematbee Sayyad Amin, Shaikh Julekha, Sayyad Khalik Sayyad Amin and Sayyad Ainul Sayyad Amin for filing a false statement before the court for granting a succession certificate.

In their response, five of them started intimidating and accusing the judge of issuing the notice in collusion with Rodga Masjid Trust. The reply also dared the judge to prove how any court could pass such orders, and stated that the court did not know the procedure to issue a certificate. They warned the court and said that they will lodge a defamation case.
The high court division bench of justice AH Joshi and justice AR Joshi, after going through the language used in the reply said that it was threatening, and merited a contempt charge.

The court, however, accepted their apology and said: “They are rustic and ignorant of the consequences of whatever they have expressed and signed.”
