Sanjeev Khanna, ex-husband of Indrani Mukerjea and an accused in the Sheena Bora murder case, has moved the Bombay high court (HC) seeking a copy of the confession statement of Indrani’s driver Shyamwar Rai.
The special CBI court had on April 15 rejected Khanna’s application stating the investigations are in progress and the prosecution has not relied on the statement. Khanna’s lawyer Shreyansh Mithare had earlier this week moved the HC challenging the order of the special CBI court, alleging not supplying copy of the statement amounts to non-compliance of statutory provisions of giving all documents to the accused.
In the petition, they have alleged “there can be no discretion of supply of material documents to an accused at the hands of prosecution or the court. In order to have a fair hearing even at the stage of bail, it is the right of the accused to be supplied with all documents.” The hearing on the petition is scheduled for Monday.
Meanwhile, on Wednesday, when all accused were produced before the special court, Khanna complained against the jail authorities for not taking him for medical examination even after the court’s order. Khanna’s lawyer later moved an application stating owing to the recent controversy over shifting of former public works department (PWD) minister Chhagan Bhujbal to hospital, Khanna has been not taken for medical examination.
The CBI also objected to the bail application of former media baron and Indrani’s husband Peter Mukerjea. CBI prosecutor Bharat Badami said Peter is a co-conspirator in the case. “You are husband of accused no. 1 (Indrani) and entered into a criminal conspiracy with her to eliminate Sheena,” Badami argued. He said Peter now wants to shift his entire burden on Indrani. The court has adjourned the hearing till Saturday.
