Sessions court to hear fake encounter case

Clearing the deck for a trial in the alleged fake encounter case of Ram Narayan Gupta alias Lakkhan Bhaiiya, the Andheri metropolitan magistrate’s court, on Tuesday, committed and transferred the case to the sessions court for commencement of trial.

Clearing the deck for a trial in the alleged fake encounter case of Ram Narayan Gupta alias Lakkhan Bhaiiya, the Andheri metropolitan magistrate’s court, on Tuesday, committed and transferred the case to the sessions court for commencement of trial.

“The magistrate’s court committed the case to the sessions court and the next hearing (in the sessions court) is on June 7,” said advocate Dhiraj Dhutmal who appears for Pradeep Sharma, along with advocate Shrikant Shivde.

Gupta was killed in an alleged fake encounter on November 11, 2006 in Nana Nani Park in Versova.

However Gupta’s brother, Advocate Ram Prasad Gupta on November 15, 2006, moved a petition in the Bombay high court alleging that the police officials murdered his brother.

Dismissed encounter specialist Pradeep Sharma is the key accused in the case.

The Special Investigation Team (SIT) on January 8, arrested Sharma, and five others in connection with the case. While Senior inspector Pradeep Suryavanshi, who allegedly lead the team of police officers on the encounter day, was arrested on March 4. SIT has in all arrested 12 accused in connection with the case.

The SIT has booked all of them for giving false information, wrongful confinement for ten or more days, kidnapping or abduction in order to murder, kidnapping or abducting with intent secretly and wrongfully to confine a person.

SIT, during the hearing of Sharma’s bail plea had told the court that five police officers are wanted in the case. The court has rejected Sharma’s bail plea twice while Suryvanshi’s bail plea. All accused are lodged in the Thane Central Jail.
