Mahim police arrested Kamal Saigal, brother of television actor Akashdeep Saigal, on Saturday for allegedly committing fraud against Tarun Kapoor in a flat purchase deal.
Kamal had been absconding since January this year after his anticipatory bail application was rejected by the Bombay High Court.
According to Kapoor’s complaint, he had purchased a flat in Vivekanand Society near Mahim Post Office from one Nanki Chellani (83) in September 2008.
He had paid Rs 40 lakh for the flat. However, he was not handed over possession of the flat.
Kapoor later learnt that Chellani had executed a gift deed in the name of Saigal and gifted the flat to him (Saigal).
Saigal then allegedly sold the flat to a third person, Smita Kanal, for Rs 75 lakh.
The money was allegedly paid through a Dubai-based party through a demand draft in the name of Meena, Saigal's wife.
“I paid the money to Chellani but did not receive possession of the flat,” Kapoor told Hindustan Times.
“I have been fighting for this since over one-and-half years as I have lost the money and not received the flat,” added Kapoor.
Kapoor had lodged a compliant against Chellani and Saigal in March 2009. After preliminary investigation, the police registered an FIR in July 2009.
Chellani who was arrested by the police, was later released on bail by the metropolitan court at Andheri.
Kapoor has filed a civil suit in the City Civil Court seeking possession of his flat.
The City Civil Court had appointed a court receiver to take possession of the flat till the dispute is decided.
Although the court receiver has taken charge of the flat, Kanal allegedly still resides there.
Kapoor alleged that Saigal has defrauded at least two other persons in a similar fashion.
