‘We live in fear of our son’

Five members of a family have moved the Sessions court seeking anticipatory bail as they fear they will be booked in a false case of domestic violence. This was done, allegedly, after the father refused his son’s demand of transferring half his property to his wife’s name.

Five members of a family have moved the Sessions court seeking anticipatory bail as they fear they will be booked in a false case of domestic violence. This was done, allegedly, after the father refused his son’s demand of transferring half his property to his wife’s name.

According to the anticipatory bail application filed by Rakesh Shah, his elder son Sashi married Radha on February 16, 2003 and both decided to live with the family at Santacruz. “Ever since the marriage, Radha’s family would constantly interfere in the running of our house,” Rakesh said in the application.

However, according to Rakesh, his wife Prabha and he overlooked all of this and tried to co-operate with Sashi and Radha in order to maintain peace at home. “In spite of all efforts, Radha would treat Prabha like a maid and would speak to her very rudely,” Rakesh said. Further, according to Rakesh, Radha would also threaten Prabha that she would file a complaint of harassment against her.

Rakesh said Sashi never took care of them and was only interested in getting his hands on their money and property.

According to Rakesh’s application, Sashi and Radha shocked the family with their behaviour in March 2010. Their younger son Ganesh was out of Mumbai on some business engagement. “Sashi demanded that I buy him a four-bedroom flat. When I refused, Sashi started screaming and shouting. Fed up, Prabha left the house without informing anyone,” Rakesh stated in the bail application.

“After some time I received a call saying that if I did not fulfill Sashi’s demands, then Radha’s family would lodge a complaint of dowry harassment against my wife and I,” Rakesh said in the application.

Rakesh said that on May 7, his house help who carries lunch to the offices of all family members, got delayed on his way to Sashi’s office. “Immediately presuming that Prabha had not sent him lunch, he called his maternal grandparents Ravi and Reshmi – both above 70 years – and said he would kill Prabha,” Rakesh said in the bail application.

Rakesh also filed a complaint with the Santacruz police station on September 6, requesting them to take appropriate preventive action against Sashi and Radha at the earliest.

“On September 24, Sashi and Radha once again picked a fight demanding a 50 per cent share in the property and threatened us,” Rakesh’s bail application stated. According to Rakesh’s statement, Radha and Sashi got very violent with them, which forced him to approach the Santacruz police station and file a non-cognisable case against them.

“However at the police station we came to know that Sashi and Radha had also filed an NC against Rakesh, Prabha, Seeta (Ganesh’s wife) and Prabha’s parents Ravi and Reshmi,” Rakesh said. “We fear that Sashi will implicate us in a false case. At the police station Sashi and Radha kept insisting that they would file a false case of harassment and have Rakesh, Prabha, Seeta, Ravi and Reshmi arrested,” Rakesh stated in his anticipatory bail application.

The duty officer also informed them that they would be taking cognisance of the complaints made by Radha and Sashi,” Rakesh said. Despite several attempts, HT could speak to neither Sashi, Radha nor their lawyers.
