The magistrate's inquiry report, conducted after the Bombay High Court ordered an investigation into the allegedly fake encounter of alleged Chhota Rajan gangster Ramnarayan Gupta, said: “…there is strong circumstantial evidence to opine that the alleged inquiry took place while the deceased was in the custody of the police.”
Magistrate R.K. Shaikh added: “In my opinion, there is enough evidence to show that the police officers themselves abducted the deceased at about 1 pm, took him to an undisclosed place, where his death was caused by police firing.”
This is the report that spelled doom for 'encounter specialist' Pradeep Sharma, who was arrested on Thursday.
These are the findings of the magistrate:
Gupta's fingerprints were not on the revolver allegedly fired by him, according to the expert report of Gangaram Sawant. He personally examined the revolver.
The injuries are on vital parts of Gupta's body. If the police really wanted to arrest him, they could have fired on his legs or hands.
Two of the bullets were not found at the spot where the police said Gupta fired at the police. The officer could not find the bullets or explain why they were nowhere to be seen.
Revolvers and pistol of officers not sent for examination. Without such an examination, expert cannot form an opinion on the exact distance of firing.
There was no blackening of Gupta's hands or burn marks on them. Such marks would have been evidence that Gupta used the revolver.
The nature of the four injuries found in the post-mortem showed that prima facie Gupta was shot from the front.
An officer said there were two exit wounds on Gupta's back. Hence, two bullets should have to be found at the spot. But this was not the case.
Police Inspector Pradeep Suryavanshi, who allegedly led the team that killed Gupta, was not at the spot at the alleged time of the encounter.
This was revealed from the entry in the station diary entry of West Control. The time of the entry was 8.15 pm.
This was the timing of the alleged encounter. Police Sub-Inspector Gaikwad [the report does not give his first name] said Suryavanshi informed them from Versova police station that one person was injured in police firing. This means that Suryavanshi was at the Versova police station at the time and not at the encounter spot.
