As many as 74 families residing at the local Silver Oak Apartments -- who have been living here from the last 10 years -- are in for a rude shock as the Punjab Financial Corporation (PFC) is claiming ownership of 6 kanal 17 marlas on which the apartments are constructed.
The apartments were developed by a leading builder of the city, Anil Chopra.
The residents alleged that Chopra played foul by showing the property owned by PFC as green area to meet the required floor area ratio (FAR) of 3:1, to get the site plan passed from the municipal corporation.
On November 28, PFC officials reached the apartment and informed the residents that they would demarcate the land, surrendered by Chopra to the PFC.
The demarcation also covered some portions of flats situated in Block-A of the apartments, while the entire empty area, being used by residents of other blocks for parking purposes would also be taken over by PFC.
A meeting of Silver Oak Apartment Residents' Welfare Association was held wherein members condemned the development.
The members have decided to seek legal reprieve as well as stringent action against whosoever is at fault.
"What is our fault? We purchased land after the plan was approved by the MC. Every owner has valid registration deed in his name. Most of the owners got their properties financed from banks and the latter also verified the credentials before sanctioning the loans. All of a sudden, we are being told that the land being used by residents is to be surrendered," said Parvez Ahmed, association president.
In 2001, Chopra purchased 35 kanal 10 marla and 72 sq feet land in an auction from PFC, falling under khasras 1299 (14 kanal 2 marla), 1376 (10 kanal 15 marla), 3278/1368 (9 kana l2 marla), 3281/1372 and 1376 (1 kanal 11 marla 72 sq feet) vide registration number 840. The site plan was passed by MC on December 9, 2002.
In the site plan, it was proposed to construct approximately 140 flats, spread over four different blocks. Parking was provided to the flats of Block-A in the front, while for other blocks, parking space was provided at the ground floor of blocks.
Comfortable passages and approaches were also provided for the convenience of the flat owners.
After completing the construction of Blocks A, B and C, the builder started giving possession to the flat owners. In 2002, these flats were reportedly sold for a price ranging between Rs. 11 lakh to 17 lakh. No construction was done at the area earmarked for Block-D.
"We never got suspicious why the builder halted construction half way after constructing 74 flats. These also included two flats constructed by the builder in the basement of a block, in violation of norms.
The builder told us that the open and leftover space would be available for parking purpose," Ahmed added.

Balconies and terraces of flats of Block-A come under the area demarcated by PFC. It is totally unjustified. Every owner has a registry in which the builder claimed that there is no encumbrance on the site and it is free from all debt. I constructed the apartments on the land provided to me after demarcation by PFC. During the later stage, if the flat owners got to know that the demarcation went wrong, it is not my fault. For the last many years, I have been raising the issue with PFC authorities for the benefit of residents. There is no threat to the existing flats. Every flat owner is being provided parking space as per the site plan shown to them during the sale of flats. Covered parking space is also available for flat owners. They can avail the same on payment.

PFC is concerned only with the 6 kanal 10 marlas of land which had been used by the builder in the site plan. We are not against residents and would try to find out an amicable solution in the coming days.
