The Noida authority has failed to adopt Uttar Pradesh (UP) apartment act-2010 that aims to safeguard interests of home buyers.
The authority on November 29, 2013 in its board meeting had approved a proposal that seeks to make certain guidelines that will pave the way for implementation of this act, which will benefit about 5 lakh home-buyers in Noida, 3 lakh investors in Greater Noida and Yamuna Expressway areas. Chairman and chief executive officer (CEO) of the Noida authority- Rama Raman on November 29, 2013 had said that this act will be implemented in 3 months of time.
“Three months have passed since a proposal was cleared in board meet last year, but the authority has not yet formed the guidelines without which this act cannot be adopted in industrial area like Noida or Greater Noida. I guess even a committee that is supposed to make enabling guidelines has not been formed,” said a senior Noida authority official, requesting anonymity.
All senior officials including CEO Rama Raman failed to answer that why the act could not be implemented even after a proposal regarding the same was approved last year.
“Officer on special duty (OSD)- Manoj Kumar Rai is taking care of this job. He is abroad for official work. I can tell you about act’s implementation progress by tomorrow,” said Pramod Kumar Agarwal additional chief executive officer (ACEO), the Noida authority.
Home-buyers, who have been staging protests for long demanding this act’s implementation, on the other hand, feel cheated by both local authorities and Realtor.
“Erring realtor go scot-free because there is no effective law that can take a realtor to task on a violation. Disappointment with concerned officials and UP government, we are garnering support through online petition. We will meet UP Governor BL Joshi, who can help in act’s implementation. If nothing works we will go to court,” said Abhishek Kumar, president of Noida Extension flat owners’ welfare association (NEFOWA).
In the absence of enabling guidelines, apartment act, is not being implemented in Noida, Greater Noida and Yamuna Expressway areas till date.
“With this act realtor in Noida will be regulated and made accountable to a buyer as per the apartment act,” said an official.
At present, no realtor in three industrial cities- Noida, Greater Noida and Yamuna Expressway is adhering to the act norms despite home-buyers consistent demands.
“Majority of realtors cheat on delivery date, flat size, rate, common facilities and construction quality among others. Officials, who are hand-in-gloves with realtors let buyers, suffer. If this act is implemented in true letter and spirit, buyers’ issue can be solved to some extent,” said a buyer.
UP apartment act got implemented in 2010 in entire state of UP barring 7 industrial cities including Noida, Greater Noida and Yamuna Expressway because these are governed by UP industrial act-1976.
