Chief architect’s term can’t be extended further, UT tells HC

The UT administration informed the Punjab and Haryana high court that there was no legal permissibility of granting further extension of tenure to its chief architect Sumit Kaur beyond October 31, when she will attain the age of superannuation.

It was submitted that she had been granted repeated extensions of her deputation period at Chandigarh on account of completion of Chandigarh’s master plan.

The high court, while taking the statement of Chandigarh administration’s counsel on record, said, that it left it to the authorities concerned to examine what should be Kaur’s remaining tenure, subject to the ceiling of the date of October 31 after which she cannot be granted extension. In April, the UT administration had first decided against the extension of Kaur’s deputation by repatriating her to Punjab, but extended it again.

Sumit Kaur’s appointment to the post of chief architect of Chandigarh continuously for three years on deputation from Punjab had been challenged through a public interest litigation filed by a Chandigarh resident Rajbir Singh Attri. The petitioner had sought directions to the administration to show cause under which authority Kaur was continuing to hold office since October 1, 2008.

The petitioner had requested for appropriate directions to the UT administration for making appointment to the chief architect’s post in a transparent manner. The court was informed that Kaur was appointed on the post on deputation for a one-year period but thereafter she had continuously been granted three extensions.

It was submitted that deputation was a short-term arrangement and cannot continue indefinitely, as was the case.
