Citing loopholes in the CBI trap case and his daughter's ill health, suspended SP (city) Deshraj Singh filed for regular bail in the CBI court on Monday.

According to sources, Anokh Singh, SHO of the Sector-26 police station, had alleged that Deshraj had demanded bribe for his daughter's treatment and he had even considered taking back his complaint.

According to the application filed by the counsel of the accused, there are two grounds for the justification of the bail of Deshraj, who is at present lodged in the Burail jail.

Firstly, the minor daughter of the accused/applicant is suffering from left brachial plexopathy, for which she is getting regular treatment from Nanavati Hospital, Mumbai, since 2010. The operation of Deshraj's minor daughter is to be conducted on December 3, 2012.

"There is no other male member in the family of the applicant to look after his three-year-old daughter Kunjal Singh. He has to make travelling arrangements and has to complete other formalities for the operation," said Vishal Garg Narwana, counsel for the accused.

According to sources, on being arrested Deshraj had also declared a similar statement that the money was a loan.

Another ground, according to the application, is that no shadow witness had joined the trapping party when the trap was laid on the accused, which is mandatory while conducting a raid.

The counsel also added that neither there was any independent corroboration of the story propounded by the prosecution nor there is any independent witness, who can back up the alleged version of the complainant regarding the talks, which allegedly took place between the complainant and the accused when the complainant went to the accused's house to give the money.

The CBI court has set November 8 as the date for deciding upon the fate of the applied bail.
