Based on the testimony of a five-year-old gangrape victim, district and sessions judge SK Aggarwal awarded 10 years jail term each to two migrant labourers hailing from Uttar Pradesh for raping their friend's daughter.
Standing near the dais earlier this year, the victim with her little fingers had pointed towards the accused - Manish and Sunil. It was her identification of accused coupled with medical evidence that proved the guilt of the accused.
The victim or her family did not come to the court on Friday, but justice was given to her with the court awarding 10 years jail, along with imposing a fine of `20,000 each on the convicts who earned a living by working as labourers. The convicts were residents of colony number 4.
Recounting the tale of horror, the victim while testifying before the court had said, “On the night of September 27, 2012, papa was having drinks with uncles (Manish and Sunil) and later they took me along and did 'wrong' with me throughout the night.”
The police had arrested Manish and Sunil on September 28, 2012, on the complaint of the victim's mother after the girl was found crying on the railway tracks with her mouth and eyes covered with mud and severe injuries on her private parts.
Both accused claimed to be falsely implicated. However, dismissing their arguments, Aggarwal said, “The accused raped a five-year-old child which is blot on society. The gravity of the offence increases as the accused are known to the victim.”
According to the police, the victim's father said on September 27 night, he had got up around 1 am to answer the nature's call and found his daughter missing, who was earlier sleeping with her three siblings. He raised the alarm and started searching for her with the help of neighbours.
The police reached the spot and girl was found near the railway tracks. The victim had told her mother and the police that two 'uncles' (convicts Manish and Sunil) who used to come to their house took her and hit her. The victim was found bleeding profusely and her face, head, and neck were soaked in mud, indicating that her tormentors showed no mercy to her while she kept crying for help and gagged her while committing the crime. She had to underwent a surgery for the reconstruction of her rectum and anus at Government Medical College and Hospital (GMCH), Sector 32.
