HC bench recuses from hearing golf club land lease case

The conflict between the Chandigarh Golf Club and the UT administration over the lease renewal issue of around 132 acres club land is not going to end any soon as the Punjab and Haryana high court division bench recused itself from hearing the case on Monday and recommended it to be listed before a co-ordinate bench.

The petition filed by the club on the issue in January last year came up for hearing before the division bench comprising justices Surya Kant and Lisa Gill on Monday when the bench recused itself from hearing it.

The UT administration had proposed that the club should pay `1.20 crore a year as lease amount to it. Previously, the court had appointed justice Kuldip Singh (retd) as a mediator and gave suggestions to both parties with the recommendation for `36 lakh per year lease amount that was opposed by the UT.

After observing that the issue was not going to die down after mediation had been tried between the club and the Chandigarh administration, the high court had on March 24 decided it to settle itself.

The case

The club had petitioned the high court challenging the UT administration's decision of enhancing its lease amount enormously and charging of `9.27 crore as rent, including interest for five years (March 2008- 2013).

As per the earlier lease that was for 20 years (1988 to 2008), the annual lease amount of the club, established on August 25, 1966, was `1 lakh. However, after the revision of lease amount in November last year it reached up to `1.61 crore annually.

In a bid to resolve the ongoing lease tussle with the club, the UT administration had in June made a proposal to reduce the lease amount by `36 lakh, making it to `1.25 crore annually.
