Insurance company fined Rs. 15,000 for denying claim for dead cow

A resident of a small sleepy village in Kharar took on an insurance company for denying claim for a duly-insured cow and will be paid the full claim amount of Rs. 50,000.  The insurance company has also been ordered to pay Rs. 10,000 as compensation for harassment for deficient services along with Rs. 5,000, as litigation cost to Singh.

Dismissing the arguments of the insurance company that complainant, Birender Singh alias Barinder Singh, of Simbal Majra, village, Kharar, had filed a false claim, district consumer disputes redressal from, SAS Nagar, has directed National Insurance Company limited, to pay Rs. 50,000, as per the insurance policy of the life risk.

Singh said that he had purchased eight cows at his village and got these insured from the insurance company in January 2013, of which one cow died in May 2013.

He claimed that his request for the claim on basis of the surveyor report, which said that the ear tag on the cow was not intact and it was not the same cow that was insured.

Countering the claim of the insurance company, the complainant said that if any kind of tampering would have been done by him then the said tag would have been found broken and not intact.

Justifying repudiation of claim, National Insurance Company Ltd, said that the ear tags being used by the insurance company were of plastic material and main portion of the tag was not pertaining to insurance company.  They claimed that the mismatch of insured cow and dead cow clearly proved that the complainant has changed the insured cow in order to get false claim.

However, the consumer forum presided over by APS Rajput, on February 26, held, "In our opinion if the tag was found intact as it is evident from the surveyor report then how it can be believed that the insured cow was not the same as the dead cow. Moreover in the post mortem examination of dead body of the cow, the tag was found intact on the ear of the insured cow. We find that the insurance company has committed deficiency of service by not settling the claim of the insured dead cow of complainant."
