Consumer forum directs 2 brick kilns to pay Rs 10,000

Fatehgarh Sahib District Consumer Disputes Redressal Forum has directed Jai Durga Trading Company (bricks and tiles manufacturer) and Nirmal Kiln Industries, Tohra to pay a consumer, Avtar Singh a sum of Rs 10,000 and deliver 7400 bricks to him.

Avtar Singh(45), a resident of Tohra village in district Patiala said that for the construction of his house in Sirhind, he had placed an order of 40,000 bricks with Jai Durga Trading Company (JDTC) and Nirmal Kiln Industries (NKI) in the first week of July, 2011.

After bargaining, the deal was struck at Rs 4,000 per thousand bricks i.e. for the total amount of Rs. 1,60,000 but NKI sent only 32,600 bricks from the premises of Jai Durga Trading Company instead of the 40,000 Avtar had ordered.

The bricks delivered by the companies were sub standard and broken. He said the companies received Rs 1,60,000 from him and issued invoice No. 555 dated 08.7.2011 regarding 40,000 bricks to the complainant.

The complainant approached the companies to replace the said bricks but they refused to do so. The companies have not been able to provide any substantial evidence to prove they had sent 40,000 bricks and that they didn't receive a payment of Rs.1,60,000 for the bricks.

The Forum accepted the complaint and ordered the companies to supply the remaining 7400 bricks and to give the complainant Rs 10,000 for mental agony and harassment caused and Rs. 5,000 as litigation charges within one month of receiving of this order.
