The district consumer disputes redressal forum has directed a local car dealer to pay exchange bonus of Rs 15,000 promised to a buyer at the time of sale of car.
The forum including its president Jaspal Singh Bhatia and members Darshan Singh, and Jyotsna Thatai also ordered the dealer to pay exchange bonus along with Rs 3000 as litigation expenses and compensation.
In its complaint against the dealer and Hyundai Motors India Limited, Balbir Singh, a resident of Jalandhar Vihar, stated that he purchased a new Hyundai i-10 car from Kosmo Automobiles for Rs 4.28 lakhs in April 2011 after he had given his old Maruti car in exchange.
Balbir said that at the time of the sale of car, the dealer had promised to pay Rs 15,000 as bonus within two-three months of the purchase of new car.
He complained, even after nine months after the purchase of new car and repeatedly requests to dealer to pay him bonus amount, the dealer had failed to pay any money to him.
In forum, Hyundai Motors replied that after receiving the concerned documents relating to exchange bonus, they disbursed the amount to dealer for payment to complainant but the dealer did not contest the case.
After hearing both the parties, the forum held that even after receipt of amount from manufacturer, the dealer had not paid the exchange bonus to complainant, thus it constitute unfair trade practice on part of the dealer.
The forum ordered the Kosmo Automobiles to pay Rs 15,000 as exchange bonus within the 15 days from the date of receipt of copy of the order.
