Consumer forum order not implemented, Mohali tehsildar’s salary attached

For non-compliance of its order of recovering compensation amount from a city-based developer, the district consumer disputes redressal forum has attached the salary of SAS Nagar tehsildar.

The forum has directed the district collector, SAS Nagar, to attach the salary of tehsildar, who didn’t get the recovery effected. The DC has also been asked to send a report to the forum on or before January 8, 2016.

The complaint came from a SAS Nagar resident, Shivdev Singh. For failing to deliver the possession of a property in stipulated time, the forum on September 5, 2013, had directed the managing directors of Chandigarh Overseas Private Limited and Greenfield Sites Management Private Limited, both based in Sector 34, to pay Rs 7.5 lakh to Shivdev, along with Rs 50,000 as compensation for mental agony and harassment.

Singh stated that he applied for a unit in the small investor scheme launched by the respondents in Sector 90, SAS Nagar.

He claimed that the total cost of the unit allotted to the complainant was Rs 5 lakh, which he paid in two instalments. Thereafter, the complainant and respondents entered into a developer-buyer agreement and lease agreement. Shivdev moved the forum as the project was not complete by March 2009 as promised. He said he was neither given the possession of the unit nor got the buyback money as per the deal.
