The Consumers Disputes Redressal Forum has asked an insurance company to release the claim of Rs 74000 and ordered the company to pay amount of claim to the complainant along with Rs 2000 as compensation and litigation expense.
Deciding on the complaint of Sippan Jain, a resident of Shakti Nagar, filed against the New India Assurance Company, from which he had purchased a Mediclaim policy for the entire family.
The complainant was diagnosed with myopia with astigmetism in his both eyes. The complainant was to undergo i-lasik treatment which he availed from a local eye hospital which cost him Rs 74,000. The claim filed by the complainant was rejected by the company by saying that myopia was a gradual descent and not Acute or sudden disease.
"It can't be believed that Myopia suddenly developed just after inception of the policy complainant kept hidden this disease before taking the policy and if someone is wearing of glasses or contact lenses for his comfort then cosmetic charges were non payable as per exclusion of the policy," defended the company.
Rejecting the claims of insurance company, the consumer forum ordered the insurance company to pay Rs 74000 to the complainant along with interest at the rate of 9% per annum from the date of repudiation of his claim till payment. The complainant was also awarded Rs 2000 on account of litigation expenses.
